Tree Amigos Survey
Terms of Service
These terms are an agreement between you and DMV Horticulture, which operates Tree Amigos Survey ("Tree Amigos", "the service"). By creating an account or using the app, you agree to them. If you use Tree Amigos for a company, you agree on behalf of that company.
The service
Tree Amigos lets you record tree inventories in the field: plot trees by GPS, describe them by voice or by hand, attach photos, share the inventory with your team, and export it.
Accounts and teams
- You sign in with your email address. Keep access to that email secure; anyone who can read it can sign in as you.
- The person who creates a company is its owner and controls who is on its team. Owners are responsible for the people they add.
- You must give accurate account information and be old enough to form a binding contract.
Subscriptions and trial
- New companies get a 30-day free trial. After the trial, continued use requires a paid subscription at the price shown when you subscribe.
- Subscriptions bought through Google Play or the Apple App Store renew automatically and are billed, managed and cancelled through that store, under its terms and refund rules.
- If a subscription lapses, you can still sign in and export your data for at least 30 days.
- We may change prices with at least 30 days' notice; changes apply at your next renewal.
Your data
You own the inventory data, photos and notes you put into Tree Amigos. You give us permission to store, process and display that data only as needed to provide the service to you and your team. You can export it any time. Our Privacy Policy explains how we handle it.
Acceptable use
Do not use Tree Amigos to break the law, to access other companies' data, to interfere with the service, or to upload content you don't have the right to use. We may suspend accounts that do.
Field data and professional judgment
Phone GPS positions can be off by several feet or more, especially under tree canopy. Voice entry can mishear words. Always review records before relying on them. Tree Amigos is a recording tool. It does not assess trees, and it is not a substitute for the professional judgment of a qualified arborist. Decisions about tree care, risk and safety are yours.
Availability
We work to keep Tree Amigos running and your data backed up, but the service is provided "as is" and "as available", without warranties of any kind to the extent the law allows. We may change or improve features over time.
Limitation of liability
To the extent the law allows, DMV Horticulture is not liable for indirect, incidental or consequential damages, or for lost data or profits, arising from your use of the service. Our total liability for any claim is limited to the amount you paid for Tree Amigos in the 12 months before the claim.
Ending your account
You can stop using Tree Amigos and ask us to delete your account at any time. We may end accounts that violate these terms, with notice where practical, and will give you a chance to export your data unless the law prevents it.
Changes to these terms
We may update these terms. We will change the date above and notify account owners of significant changes. Continuing to use the service after a change means you accept it.
Governing law
These terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-law rules.
